1. Acceptance
These Terms of Use govern your access to and use of VitaTrail. By using the app or website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use VitaTrail.
2. Eligibility
VitaTrail is intended for users who are at least 18 years old, or the age of majority in their location. If you use VitaTrail for a family member or managed profile, you represent that you have the authority or consent needed to do so.
3. Wellness Service Only
VitaTrail provides educational wellness information, record organization, AI-assisted explanations, vitality trends, reminders, and family care tools. VitaTrail is not a medical device unless separately cleared or approved by the relevant regulator, and it does not provide diagnosis, treatment, prescriptions, emergency response, or professional medical advice.
4. Accounts and Security
You may sign in with supported account providers such as Apple or Google. You are responsible for keeping your device, account, and credentials secure. You must provide accurate information and promptly update information that becomes inaccurate.
5. Health Records and User Content
You retain ownership of the health records, photos, notes, and other content you upload. You grant VitaTrail the limited rights needed to host, process, analyze, display, back up, and transmit that content to provide the service. You must not upload content you do not have the right to use or share.
6. AI Outputs
AI outputs are generated from available information and may be incomplete, inaccurate, outdated, or misinterpreted. You are responsible for reviewing extracted markers and summaries before relying on them. Do not use AI output as a substitute for a clinician, medical diagnosis, medication instructions, or emergency care.
7. Family Sharing and Managed Profiles
VitaTrail may allow you to invite caregivers, request access from family members, revoke sharing, view access records, or create managed profiles for relatives who do not use the app. You are responsible for obtaining appropriate consent before uploading or sharing another person's health information. Shared users must respect permission limits and confidentiality.
8. Subscriptions and Payments
Premium features may be offered through Apple App Store or Google Play subscriptions. Billing, renewal, cancellation, refunds, and payment methods are managed by the applicable app store according to its terms. Cancelling a subscription stops future renewal but may not refund prior charges unless the app store provides a refund.
9. Acceptable Use
- Do not use VitaTrail for emergencies, diagnosis, treatment, or medication dosing decisions.
- Do not upload unlawful, harmful, misleading, or unauthorized content.
- Do not attempt to reverse engineer, overload, scrape, attack, or bypass security or access controls.
- Do not use another person's account or health data without permission.
- Do not use VitaTrail to make discriminatory, employment, insurance, credit, or legal decisions about another person.
10. Third-Party Services
VitaTrail may rely on app stores, sign-in providers, cloud hosting, AI providers, analytics, support tools, and other third-party services. Their terms and privacy policies may also apply.
11. Intellectual Property
VitaTrail, including its design, software, branding, logos, and non-user content, is owned by VitaTrail or its licensors. These Terms do not transfer intellectual property rights except for the limited right to use the service as permitted.
12. Disclaimers
VitaTrail is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, error-free, or medically accurate. We do not guarantee that AI outputs, extracted markers, reminders, or vitality scores will detect or prevent any condition.
13. Limitation of Liability
To the maximum extent permitted by law, VitaTrail and its operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or health outcomes arising from use of the service.
14. Termination
You may stop using VitaTrail at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay required fees, or use the service unlawfully. You may request account deletion through the app or public deletion page.
15. Changes
We may update these Terms. Continued use after an update means you accept the updated Terms, unless local law requires a different process.
16. Governing Law
Before launch, replace this section with the governing law and dispute resolution language selected by your legal counsel for the markets where VitaTrail is offered.
